1. Acceptance of Terms

By accessing or using Naughti.ai (the “Service” or the “Site” or “Company”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.
If you do not agree to all Terms or are under the age of 18, you must immediately stop using the Service.

2. Eligibility and Age Restriction

Naughti.ai is exclusively intended for users 18 years of age or older (or the legal age of majority in your jurisdiction, whichever is higher).
By using the Service, you confirm and warrant that:
You are at least 18 years old.
You have the legal capacity to enter into these Terms.
You represent and warrant that accessing this product is permitted under the laws applicable to you, and that you are solely responsible for determining whether such access is lawful in your jurisdiction. The Company does not guarantee that the Service is legal in any specific location.
All interactions on the Service are understood as purely fictional.

3. Nature of the Service

Naughti.ai provides fantasy-based AI roleplay entertainment, enabling users to interact with fictional AI characters via chat and optional AI-generated media.
In compliance with 18 U.S.C. § 2257 and applicable international laws:
All characters are fictional, AI-generated, and do not represent actual human beings.
All characters depicted in sexual situations are visually and contextually portrayed as adults (18+).
No real humans were used in the creation of the sexual conduct depicted.
The Service provides digital entertainment only and does not offer any live interaction, live performers, escorting, dating services, facilitation of meetings, physical interactions, or any real-world sexual, financial, or emotional engagements.

4. AI Content & Fiction Disclaimer

All conversations between users and AI characters are entirely fictional and generated solely for entertainment purposes.
You acknowledge that:
AI characters do not possess emotions, consciousness, physical bodies, or real-world intent.
AI characters cannot form actual relationships, meet in person, or fulfill promises.
Any messages suggesting meetings, payments, gifts, obligations, or real-world actions are fully fictional and non-actionable.
Hallucinations: Because the Service relies on generative AI, outputs may be inaccurate or inconsistent. The Service should not be used for medical, legal, financial, or psychological advice.

5. User Accounts & Security

To access certain features, you must register an account. You agree to:
Provide accurate and current information.
Keep your login credentials confidential.
Accept responsibility for all activities that occur under your account.
Naughti.ai is not responsible for any loss or damage arising from your failure to safeguard your account credentials.

6. Acceptable Use & Prohibited Content

Strict Zero-Tolerance Policy: To maintain our payment processing agreements and legal standing, the Service strictly prohibits the generation, uploading, or solicitation of content involving:
Child Sexual Abuse Material (CSAM): Any depiction of minors or individuals appearing to be under 18. We report all CSAM to relevant authorities (e.g., NCMEC, Europol).
Non-Consensual Sexual Content: Rape, sexual assault, or lack of consent.
Violence & Gore: Mutilation, torture, or extreme violence.
Bestiality/Zoophilia: Sexual acts with animals.
Deepfakes: Generating images or roleplays depicting real, identifiable people (celebrities, politicians, or private citizens) without their consent.
Incest: Biological familial sexual relationships (Parent/Child, Sibling/Sibling).
Hate Speech: Content promoting violence or hatred against protected groups.
Moderation & Enforcement: We reserve the right to monitor interactions using automated systems to enforce these rules. Violations will result in immediate account termination without refund and permanent banning.

Off-Platform Use of Generated Content

Users understand that any content generated through the Service is intended solely for private use inside the platform and must not be published, shared, or redistributed where it may violate applicable law, privacy rights, or third-party rights. The Company has no control over how users use content outside of the Service and accepts no responsibility for consequences arising from redistribution, publication, or reproduction of generated content.

User Responsibility for Generated Content

Users acknowledge that all content generated through the Service is based on their prompts, instructions, and interactions. By using the Service, the user accepts full legal responsibility for any content they request, generate, display, transmit, or store through their account.
Users agree that they will not request or attempt to generate content involving:
individuals under 18 years old (real, fictional, implied, or role-played)
incest-related relationships
non-consensual acts, coercion, abuse, or exploitation
real identifiable persons (including celebrities or individuals from personal life)
illegal activities
If a user intentionally attempts to produce such content, attempts to bypass safety controls, or succeeds in doing so, the user bears full legal responsibility for the result and any consequences arising from it.
Naughti.ai provides technical safeguards to prevent such content; however, these systems may not prevent all misuse. Users agree that any attempt to manipulate the platform into generating prohibited content constitutes intentional misuse and breach of this agreement.
The user acknowledges that continuing an illegal, unsafe, or prohibited prompt after automated warnings or refusal constitutes intentional misuse regardless of whether the initial content was system-generated or user-initiated

User Notifications of Violations

Users agree to notify the Service immediately if they encounter content that may violate these Terms or appear unsafe, illegal, or harmful. Failure to notify shall limit any rights to dispute, refund, claim damages, or allege platform negligence.

Reporting Obligations

The Company reserves the right to report any user activity that involves suspected illegal content, including but not limited to content involving minors, real non-consenting individuals, human trafficking, or threats of violence, to relevant authorities, payment processors, or investigative agencies.

7. Keys & Subscriptions

Definitions:
“Key”: A consumable digital credit that unlocks access to a specific fantasy scenario for a limited time (e.g., 48 hours). Keys are consumed upon use.
“Subscription”: A recurring time-based plan granting access to fantasy scenarios for the active billing period.
Pricing: Prices are displayed clearly at checkout. We reserve the right to change pricing for future purchases. Existing subscriptions will renew at the agreed rate unless notified otherwise.

8. Payments & Billing

All payments are processed by authorized third-party payment providers (the "Processor"). Naughti.ai does not store full credit card numbers.
Authorization: By selecting a Key pack or Subscription, you authorize us (through our Processor) to charge your payment method.
Recurring Billing: Subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the renewal date.
Billing Descriptor: Charges will appear on your payment statement under a merchant name associated with Naughti.ai or its authorized payment partners.

9. Refund Policy & Right of Withdrawal (EU)

Digital Content Waiver: As an EU-based company, we comply with the Consumer Rights Directive. However, because we provide immediate access to digital content:
YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE CONTRACT AND ACKNOWLEDGE THAT YOU THEREBY LOSE YOUR RIGHT OF WITHDRAWAL (THE 14-DAY COOLING-OFF PERIOD) ONCE THE DIGITAL CONTENT (KEYS OR SUBSCRIPTION ACCESS) IS DELIVERED.
Refund Conditions: Generally, all sales are final. Refunds are discretionary and may only be granted in cases of:
Technical Error: Double billing or platform outage preventing access `>`24 hours.
Unauthorized Use: Verified fraud claims.
No Refunds for Usage: We do not offer refunds for "change of mind," dissatisfaction with AI responses, or unused Keys/Subscription time.
Chargebacks: If you initiate a chargeback or dispute with your bank without contacting support first, your account will be permanently banned. We vigorously contest invalid chargebacks and provide evidence of usage/IP logs to payment processors.

10. Intellectual Property

Our IP: The Site, code, interface, and base AI characters are owned by Naughti.ai.
Generations: Subject to these Terms, you own the specific text outputs generated by your prompts for personal, non-commercial use.
Restrictions: You may not scrape, reverse engineer, or use our content to train other AI models.

11. Account Termination

We may suspend or terminate your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation:
Breach of these Terms.
Suspected fraud or payment abuse.
Requests by law enforcement.
Upon termination, your right to use the Service will immediately cease, and any remaining Keys or Subscription time will be forfeited.

12. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties regarding the accuracy, reliability, or availability of the AI characters or the platform.

13. Limitation of Liability

To the maximum extent permitted by applicable law (including Estonian Law): In no event shall Naughti.ai, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Service.
Our total liability for any claim shall not exceed the amount you paid to us during the six (6) months prior to the event giving rise to the claim.

14. Indemnification

The user agrees to indemnify, defend, and hold harmless Naughti.ai, its owners, employees, affiliates, and service providers from any claim, investigation, liability, legal proceeding, loss, fine, or damage arising from:
user-submitted content
user attempts to generate illegal or harmful content
violations of age restrictions
unlawful usage of the Service
This indemnification obligation survives account termination.

15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Estonia. Any dispute arising out of or in connection with these Terms shall be settled by the Harju County Court (Harju Maakohus) in Tallinn, Estonia, unless mandatory consumer protection laws in your country of residence require otherwise.

16. System Safeguards Disclaimer

The Service implements moderation logic, filters, and restrictions to prevent unsafe or illegal material; however, no automated system is guaranteed to prevent 100% of misuse. Users understand and agree that bypassing, overriding, or attempting to circumvent these systems means they are acting outside the intended use of the Service and assume full liability.
The Service shall not be considered the publisher or creator of such content and shall not be liable for any actions taken based on such content.
The Company has no legal obligation to actively monitor user interactions, conversations, or stored data, and does not commit to doing so. Safety features and analysis functions operate solely to maintain platform integrity and not to guarantee prevention of misuse. Users remain solely responsible for all content generated through their inputs.

17. User Data in Chat Messages

Users shall not provide or input personal data belonging to third parties into the Service. If users choose to input any personal data, including names or likenesses of real persons, they represent that they have obtained lawful authorization from those individuals.
The Service assumes no responsibility for verifying the accuracy of such representations.
